Terms for everyone

1. Agreement

These terms are an agreement between you and TKNQ ("TKNQ", "we", "us") governing your use of the MyGym web platform, the MyCoach mobile app, and the tknq.io website (together, the "Services"). By creating an account or using the Services you accept these terms and our Privacy Policy.

2. Beta status

TKNQ is in a closed founding-gym beta. During beta: features may change, be added, or be removed without notice; occasional downtime or bugs are expected; and we do not offer a service-level guarantee. We work closely with founding gyms and prioritise fixes, but you should not treat the Services as fault-free during this period.

3. Your account

• Sign-in is via Google or email/password. Keep your credentials secure — you are responsible for activity on your account.
• Provide accurate information and keep it up to date.
• You must be at least 16 to hold an account, or have the consent and supervision of a parent or guardian.

4. Acceptable use

You agree not to:

• use the Services unlawfully, or upload content you don't have the right to upload;
• attempt to access another user's or another gym's data;
• probe, disrupt, reverse-engineer, or overload the Services;
• upload malicious code or content that is abusive, infringing, or deceptive;
• resell or white-label the Services without a written agreement with us.

5. Intellectual property

The Services — including software, design, branding, and AI-generated report formats — are owned by TKNQ or its licensors. We grant you a personal, non-transferable, revocable licence to use the Services as intended. You keep ownership of the content you upload (see Parts B and C for the licences you grant us so we can operate the Services).

6. Disclaimers and Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that: the Services are provided "as is" during beta, and we make no warranty that they will be uninterrupted, error-free, or fit for a particular purpose beyond what the law requires.

7. Liability

To the maximum extent permitted by law, TKNQ is not liable for indirect or consequential loss (including lost profits, lost data recoverable from your own records, or business interruption), and our total aggregate liability for claims connected with the Services is limited to the amounts you paid us in the 12 months before the claim (or A$100 if you have paid nothing). Where liability cannot be excluded but can be limited, it is limited to re-supplying the relevant service or paying the cost of re-supply.

8. Termination

You can stop using the Services and request account deletion at any time. We may suspend or terminate accounts that breach these terms, create security risk, or are required to be closed by law — with notice where practicable. Sections 5–7 and 9 survive termination.

9. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and TKNQ submit to the non-exclusive jurisdiction of its courts.

10. Changes to these terms

We may update these terms as the products evolve. The "Last updated" date reflects the current version; material changes will be announced in-product or by email, and continued use after a change is acceptance of it.

Additional terms for gym owners (MyGym)

11. Subscription and fees

MyGym is offered on a subscription basis, billed via Stripe. Founding-beta pricing and terms are as agreed with you during onboarding. Fees are in Australian dollars unless stated otherwise.

12. Member payments — you are the merchant

• Membership payments are collected from your members through your own connected Stripe account. You are the merchant of record: the payment relationship, receipts, refunds, and disputes are between you and your member.
• TKNQ does not deduct a platform fee or commission from member payments.
• You are responsible for setting your prices, membership terms, refund policy, and any applicable taxes.

13. Your members' data

• You control the member records you enter into MyGym. You are responsible for collecting that information lawfully — including any consent needed from members and, for minors, from parents or guardians — and for keeping it accurate.
• TKNQ processes member records only to provide the Services to you and per our Privacy Policy; we do not use your member list for our own marketing.
• Waiver text, announcements, curriculum content, and similar materials you publish through MyGym are your content and your responsibility. You grant us a licence to host and display them to operate the Services.

Additional terms for members (MyCoach)

14. Your videos

• You keep ownership of footage you upload. You grant TKNQ a limited licence to store and process it solely to provide your analysis and coaching reports — not to publish it, share it, or train third-party AI models with it.
• You warrant that you have the right to upload the footage — including that the training partners visible in it are aware of and okay with the recording being uploaded for your private analysis.
• You can delete a video and its analysis at any time in the app.

15. AI coaching output — safety disclaimer

AI-generated analyses, grades, and prescribed drills are general training information, not professional advice. They are not medical advice, physiotherapy, or a substitute for instruction from a qualified coach. Brazilian Jiu-Jitsu is a physically demanding contact sport with inherent risk of injury. Train within your limits, under qualified supervision, and consult a medical professional before acting on training suggestions if you have any health condition or injury. You use training suggestions at your own risk.

16. Your gym relationship

• Membership payments you make through the Services go to your gym (see section 12) — billing questions and refunds are handled by your gym.
• Attendance, rank, and membership records shown in the app come from your gym's records; ask your gym to correct them.
• Your training journal is private to you and is not visible to your gym or coaches.
